Call to the Notary
A notary is called and designated to a region by Justice Minister, on a motion of interested person, after consulting proper Notary Chamber.
A person willing to become a notary must satisfy below conditions:
- is a citizen of Poland and uses fully his civil rights,
- his character is flawless,
- has a law degree,
- fulfilled a notary application,
- passed the notary exam,
- worked as a notary assessor at least 2 years,
- is in age of at least 26.
Conditions mentioned above don't apply to:
- readers and professors of law,
- judges, prosecutors, barristers and legal counselors with at least 3 year practice.
Justice Minister dismisses a notary if a notary:
- resigned from leading his office,
- due to illness or handicap become, by verdict of medical committee, found permanently unable to fulfill duties of notary or without justified reason refused to undergo such examination despite recommendation of committee of proper notary chamber,
- exceeded age of 70,
- were deprived of right to lead his office by disciplinary court,
- has lost under the verdict of court his civil rights or right to work as a notary,
Notary dismissal due to point 2 follows after hearing of the notary, unless it is impossible.
Justice Minister can dismiss a notary, who has got two negative opinions as a result of visitations made by a notary visitator or proper part of Justice Minister. Dismissal follows after consideration the case by proper disciplinary court, on motion moved by Justice Minister.
